Terms of Use

These Terms of Use apply to all HopeSays applications developed by E.S.Yu Studio, including HopeSays AAC, HopeSays Daily, HopeSays Feel, and HopeSays Feel Kids, as well as the HopeSays website. By downloading, installing, accessing, or using any HopeSays app or this website, you agree to these Terms.

E.S.Yu Studio grants you a personal, non-exclusive, non-transferable license to use HopeSays apps for personal, educational, clinical-support, caregiver-support, or organizational support purposes, subject to these Terms and any applicable app store terms.

You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works based on HopeSays apps, website materials, software, designs, or content, except as permitted by applicable law.

HopeSays apps may be distributed through app stores, approved testing programs, direct links, or other authorized channels. Features, availability, pricing, supported devices, and distribution methods may change over time.

E.S.Yu Studio may update, modify, suspend, or discontinue any app or feature at any time. Updates may be required for continued use or compatibility with supported devices and operating systems.

Do not rely on HopeSays apps for clinical decision-making, diagnosis, treatment, or safety-critical decisions. Always work with qualified professionals, such as speech-language pathologists, BCBAs, psychologists, physicians, educators, or other appropriate providers, for individualized assessment, intervention, and care planning.

HopeSays Daily may include SOS-style communication features to help a user express urgent needs. These features do not contact emergency services and may not work if a device is muted, offline, out of battery, damaged, inaccessible, or unheard by nearby people. In any life-threatening or urgent safety situation, contact local emergency services immediately.

Professionals, organizations, caregivers, and supporting adults are responsible for determining whether HopeSays apps are appropriate for a specific user, student, client, patient, or setting.

Use of HopeSays apps does not create a provider-client, therapist-client, clinician-client, doctor-patient, school-service, or supervisory relationship between E.S.Yu Studio and any user, client, student, patient, family, professional, or organization.

HopeSays apps should be used with appropriate adult support, supervision, and professional judgment, especially when used by children, users with disabilities, medically vulnerable individuals, or users with safety-related needs.

All content, designs, branding, logos, app interfaces, written phrases, visual systems, software, code, and other materials in HopeSays apps and the HopeSays website are owned by E.S.Yu Studio or used with permission. “HopeSays,” “E.S.Yu Studio,” product names, logos, and related marks are trademarks or trade names of E.S.Yu Studio.

Unauthorized use, copying, distribution, modification, publication, or commercial exploitation is prohibited.

HopeSays apps and the HopeSays website are provided “as is” and “as available,” without warranties of any kind, express or implied. E.S.Yu Studio does not warrant that the apps or website will be uninterrupted, error-free, secure, or suitable for any particular purpose.

To the fullest extent permitted by applicable law, E.S.Yu Studio shall not be liable for any indirect, incidental, consequential, special, punitive, or similar damages arising from or related to the use of, or inability to use, HopeSays apps or the HopeSays website.

E.S.Yu Studio may update these Terms of Use as the apps, website, or legal requirements evolve. The current version will be available on this page. Continued use of HopeSays apps or the website after updates means you accept the revised Terms.
